Refund and Cancellation Policy
This policy outlines the terms for charter cancellations, rescheduling, and refunds for services provided by Nantucket Surf Boat.
1. Captain's Authority and Safety
The safety of our passengers, crew, and vessel is our highest priority. The Captain retains final authority regarding the suitability of conditions for departure and continuation of any charter.
2. Cancellation by Charterer

Note: All cancellation requests must be submitted in writing (via email to info@nantucketsurfboat.com).
3. Cancellation Due to Weather
A. Weather-Related Cancellation by the Captain/Company:
If the Captain determines that weather conditions (e.g., high winds, heavy rain, thunderstorms, dense fog, or small craft advisories) are unsafe or unsuitable for the charter, the following applies:

Primary Option: Reschedule: The Charterer will be offered the opportunity to reschedule the charter for a mutually agreeable date within [12 months] of the original booking date. There will be no additional charges for this reschedule.

Secondary Option: Refund: If a mutually agreeable reschedule date cannot be found, the Charterer will receive a full refund of all amounts paid.
A charter cancellation based on weather is at the sole discretion of the Captain. Rain alone does not typically warrant a cancellation unless it significantly impairs visibility or is accompanied by other severe conditions.
B. Cancellation Due to Weather by Charterer:
If the Charterer chooses to cancel based on weather when the Captain deems the conditions safe and the charter is proceeding, this will be treated as a "Cancellation by Charterer" (Section 2) and the standard forfeiture rules will apply.
4. Cancellation Due to Extenuating Circumstances
A. Cancellation Due to Charter Operations (Company-Related):
If the charter is cancelled by Nantucket Surf Boat due to unforeseen mechanical failure, vessel damage, or crew unavailability, the following applies:

Primary Option: Reschedule: The Charterer will be offered the opportunity to reschedule the charter for a mutually agreeable date within 12 months.

Secondary Option: Refund: If a mutually agreeable reschedule date cannot be found, the Charterer will receive a full refund of all amounts paid.
B. Cancellation Due to Charterer's Extenuating Circumstances:
Cancellations by the Charterer due to illness, travel issues, personal emergencies, or other circumstances unrelated to the operation of the vessel or safety (e.g., flight cancellations, transportation issues, etc.) are treated as a "Cancellation by Charterer" (Section 2). Refunds are not provided for these types of cancellations. Rescheduling may be considered based on the notice given (see Section 2).
5. Summary of Refund Eligibility
In all cases where a refund is due, processing may take up to 30 business days.
